END USER LICENSE AGREEMENT (EULA)

END USER LICENSE AGREEMENT This End User License Agreement (“Agreement”) is between you and Rork (“Company”) regarding your use of Emergency Tracker and associated services (the “Service”). BY DOWNLOADING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. 1. LICENSE GRANT Subject to your compliance with this Agreement, Company grants you a limited, non-exclusive, non-transferable license to download, install, and use the Service on your personal devices solely for your personal, non-commercial use. 2. RESTRICTIONS You may not: (a) copy, modify, or create derivative works of the Service; (b) reverse engineer, disassemble, or decompile the Service; (c) rent, lease, lend, sell, redistribute, or sublicense the Service; (d) remove or alter any proprietary notices or labels. 3. LOCATION DATA The Service collects and processes location data to provide emergency location sharing features. Location data is processed locally on your device and only shared when you explicitly choose to send it via SMS to selected contacts. No location data is stored on external servers. 4. PRIVACY Your privacy is important to us. The Service only accesses your location and contacts when necessary for core functionality. No personal data is transmitted to third parties except as explicitly initiated by you (SMS sharing). 5. DISCLAIMER OF WARRANTIES THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 6. LIMITATION OF LIABILITY IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. 7. EMERGENCY USE While the Service is designed to assist in emergency situations, it should not be relied upon as the sole means of emergency communication. Always contact emergency services directly when immediate assistance is required. 8. TERMINATION This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any term hereof. 9. GOVERNING LAW This Agreement shall be governed by the laws of the United States, without regard to conflict of law principles. Last updated: January 21, 2025
